Alcara Capital provides a technology platform that facilitates copy trading services. We DO NOT:

• Act as a broker, dealer, or investment advisor
• Hold, custody, or manage user funds directly
• Guarantee any specific investment returns or outcomes
• Represent ourselves as a registered investment company or fund

All trading is executed through third-party regulated brokers. We are solely a technology service provider.

3. Risk Acknowledgment

TRADING INVOLVES SUBSTANTIAL RISK OF LOSS. BY USING THIS SERVICE, YOU ACKNOWLEDGE AND ACCEPT THAT:

• You may lose some or all of your invested capital
• Past performance is not indicative of future results
• No trading system or strategy is guaranteed to be profitable
• Market conditions can change rapidly and unpredictably
• Copy trading does not eliminate risk
• You are solely responsible for all trading decisions made through your account

4. Eligibility and Account Registration

To use the Service, you must:

• Be at least 18 years of age (or the age of majority in your jurisdiction)
• Have the legal capacity to enter into binding contracts
• Not be located in a jurisdiction where the Service is prohibited
• Provide accurate and complete registration information
• Maintain a valid account with a supported third-party broker

You are responsible for maintaining the confidentiality of your account credentials and for all activities under your account.

5. User Responsibilities

You agree to:

• Conduct your own due diligence before making any investment decisions
• Consult with qualified financial advisors as appropriate
• Only invest capital that you can afford to lose

6. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW:

• The Company shall not be liable for any trading losses or investment losses of any kind
• The Service is provided "AS IS" and "AS AVAILABLE" without warranties of any kind
• We do not guarantee uninterrupted or error-free service
• We are not responsible for the actions or performance of third-party traders
• We are not liable for technical failures, interruptions, or data loss
• Our total liability shall not exceed the fees you paid to us in the 12 months preceding the claim

In no event shall the Company be liable for indirect, incidental, special, consequential, or punitive damages.

7. No Investment Advice

The Company does not provide investment advice. Any information, analysis, or commentary provided through the Service:

• Is for informational purposes only
• Does not constitute a recommendation to buy or sell any security
• Should not be relied upon as the sole basis for investment decisions

8. Fees and Payments

Users agree to pay all applicable fees as disclosed on the platform. Fees may include:

All fees are non-refundable unless otherwise required by law. We reserve the right to modify fees with 30 days' notice.

• Your violation of these Terms
• Your violation of any applicable laws or regulations
• Your trading activities and investment decisions

10. Termination

We reserve the right to suspend or terminate your access to the Service at any time, with or without cause or notice, including for:

• Violation of these Terms
• Fraudulent or illegal activity
• Extended inactivity
• At our sole discretion for any reason

Upon termination, your right to use the Service will immediately cease. Provisions that by their nature should survive termination shall survive.

11. Third-Party Services

The Service integrates with third-party brokers and service providers. We are not responsible for:

• The actions, policies, or practices of third-party brokers
• The availability or reliability of third-party services
• Disputes between you and third-party service providers
• Changes to third-party terms or services

12. Intellectual Property

All content, features, and functionality of the Service are owned by Alcara Capital and protected by copyright, trademark, and other intellectual property laws. You may not copy, modify, distribute, or create derivative works without our express written permission.

13. Dispute Resolution and Arbitration

Any dispute arising from these Terms or your use of the Service shall be resolved through binding arbitration in accordance with the rules of the American Arbitration Association, except where prohibited by law.

You waive your right to participate in class action lawsuits or class-wide arbitration.
